TERMS OF SERVICE

OVERVIEW

These Terms of Service apply to all orders placed through the online store rushoranow.com. The store is operated by Vitrin Mode UG (haftungsbeschränkt), S1 4, 68161 Mannheim, Germany, registered at the Amtsgericht Mannheim under HRB 734501, represented by the managing director Murat Vurucu (hereinafter "rushoranow", "we", "us" or "our").

By visiting our store or placing an order, you agree to these Terms of Service. Please read them carefully before making a purchase.

SECTION 1: SCOPE

1.1 These terms apply to all contracts concluded between you and us through rushoranow.com in the version valid at the time of your order.

1.2 Our offer is directed at consumers and business customers with a delivery address in Germany. We only ship within Germany.

1.3 A consumer is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business or profession.

SECTION 2: CONCLUSION OF THE CONTRACT

2.1 The products shown in our store do not constitute a legally binding offer, but an invitation for you to place an order.

2.2 By clicking the order button at the end of the checkout process, you submit a binding offer to purchase the items in your shopping cart. Before submitting your order, you can review all details and correct any input errors.

2.3 After receiving your order, we will send you an automatic email confirming that we have received it. This confirmation does not yet mean that your order has been accepted. The contract is concluded when we send you a separate order or shipping confirmation by email, or when we dispatch the goods.

2.4 The contract language is English. We save the text of the contract and send you the order details by email. You can also print or save these terms at any time from our website.

SECTION 3: PRICES AND SHIPPING COSTS

3.1 All prices shown in our store are final prices in euros and include the statutory German value added tax.

3.2 Standard shipping within Germany is free of charge. Insured express shipping is available for 2.95 EUR. Further details can be found in our Shipping Policy.

SECTION 4: PAYMENT

4.1 The payment methods available to you are shown during the checkout process.

4.2 Payment is due immediately when the order is placed, unless the selected payment method provides otherwise. Payments are processed by external payment service providers, whose own terms may also apply.

SECTION 5: DELIVERY

5.1 We deliver exclusively to addresses within Germany.

5.2 Free standard shipping usually takes 4 to 5 business days. Insured express shipping usually takes 3 to 5 business days. Delivery times begin once your order has been placed and paid for.

5.3 If an item is unexpectedly out of stock after your order, we will inform you without delay and refund any payment already made.

SECTION 6: RETENTION OF TITLE

The goods remain our property until full payment of the purchase price.

SECTION 7: RIGHT OF WITHDRAWAL

As a consumer, you have a statutory right of withdrawal of 14 days. Full details, including the model withdrawal form, can be found in our Returns and Refunds Policy.

SECTION 8: WARRANTY

8.1 The statutory warranty rights apply to all products purchased from us.

8.2 If you receive a damaged or faulty item, please contact us at info@rushoranow.com with a short description and a photo so that we can resolve the matter quickly. This request does not affect your statutory rights.

SECTION 9: LIABILITY

9.1 We are fully liable for damages resulting from injury to life, body or health, for damages caused intentionally or through gross negligence, and for claims under the German Product Liability Act.

9.2 In the case of slightly negligent breach of an essential contractual obligation, our liability is limited to the foreseeable damage typical for this type of contract. Essential contractual obligations are those whose fulfilment makes the proper performance of the contract possible in the first place and on which you may regularly rely.

9.3 Any further liability is excluded.

SECTION 10: ACCURACY OF INFORMATION

We make every effort to present our products, colours and prices correctly. Small differences in colour may occur due to screen settings. If our website contains an obvious error, for example in a price, we reserve the right to correct it. If an order has already been placed, we will contact you before processing it.

SECTION 11: USE OF THE WEBSITE

You may not use our website for unlawful purposes, to infringe the rights of others, to transmit viruses or malicious code, to collect personal data of other users, or to interfere with the security features of the website. We may restrict access to the website in the event of misuse.

SECTION 12: INTELLECTUAL PROPERTY

All content on rushoranow.com, including texts, product photos, graphics and logos, is our property or that of our licensors and is protected by copyright. Any use requires our prior written consent.

SECTION 13: COMMENTS AND FEEDBACK

If you send us comments, reviews, suggestions or other feedback, you agree that we may use them free of charge to improve our products and services. Your feedback must not violate the rights of third parties or contain unlawful or offensive content.

SECTION 14: APPLICABLE LAW AND PLACE OF JURISDICTION

14.1 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only insofar as it does not remove the protection granted by mandatory provisions of the law of the country in which they have their habitual residence.

14.2 If you are a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from this contract is Mannheim, Germany.

SECTION 15: SEVERABILITY

If any provision of these terms is or becomes invalid, the validity of the remaining provisions remains unaffected.

SECTION 16: CHANGES TO THESE TERMS

We may update these Terms of Service from time to time. The version valid at the time of your order always applies to that order.
